Reference Filed Against Justice Shams Mehmood Mirza Over PKR 400 Million Revenue Loss
A reference has been filed against LHC Justice Shams Mehmood Mirza by the government's appointed assistant attorney general, Shiraz Zaka.
The claim made in the reference is that the government has lost revenue of 400 million PKR due to Justice Shams's order. A reference has been filed on the basis of Article 209, where the JCP will send their recommendation to the president, and he may remove him if the president agrees with the opinion of JCP. It is very important to note that only the president has the authority to remove the judge, and the judge can only be removed by a JCP opinion sent to the president, and there is no other way to remove the judge in Pakistan.
Moreover, it has been claimed that in a private company vs. the Ministry of Petroleum case, the issue is still pending deliberation; since 7 years ago, only 3 hearings have been held.
It is important to note that Justice Shams is also included in the larger-member bench for-hearing-the-related to Ex-PM Imran Khan's disqualification pending in LHC.
